Magic Wishes Vacations - Terms and Conditions

Please read these Terms and Conditions carefully. By booking a vacation with Magic Wishes Vacations ("the Company," "we," "us," or "our"), you ("the Client," "you," or "your") agree to be bound by these Terms and Conditions, which form a legally binding agreement between you and Magic Wishes Vacations.

1. Definitions

"Company" / "Magic Wishes Vacations": Refers to Magic Wishes Vacations, the travel agency arranging your vacation.

"Client" / "You": Refers to the person(s) named on the booking confirmation who is purchasing the vacation package.

"Vacation Package" / "Services": Refers to the travel arrangements, including but not limited to flights, accommodation, tours, transfers, and other services booked through Magic Wishes Vacations.

"Supplier": Refers to any third-party provider of services included in your Vacation Package, such as airlines, hotels, tour operators, cruise lines, and transportation companies.

"Booking Confirmation": The document issued by Magic Wishes Vacations detailing the confirmed services, dates, prices, and other relevant information.

2. Booking and Payments

2a. Agency Relationship with Suppliers
Magic Wishes Vacations acts solely as an agent for third-party Suppliers that provide the travel services included in your Vacation Package. We do not own, operate, or control any airlines, hotels, cruise lines, transportation companies, or other travel service providers. Your booking constitutes a contract between you and the applicable Supplier(s), and your travel arrangements are subject to the terms and conditions, policies, and limitations of liability imposed by those Suppliers.

2b. Supplier Payment, Cancellation, and Refund Terms
All payments, penalties, cancellations, and refunds are ultimately governed by the individual Supplier’s terms and conditions, which may be more restrictive than the general policies outlined in this document. While Magic Wishes Vacations will assist with communicating your requests to Suppliers, we have no authority to override their policies. Any refunds, credits, or changes are subject to Supplier approval, and any fees charged by Suppliers are the responsibility of the Client.

2c. Travel Insurance Recommendation and Waiver
Magic Wishes Vacations strongly recommends that all Clients purchase comprehensive travel insurance to protect against cancellations, interruptions, delays, medical emergencies, and other unforeseen events (see also Section 7). If you choose to decline travel insurance, you acknowledge that you are solely responsible for any losses, costs, or expenses incurred and that you will not hold Magic Wishes Vacations liable for any lack of coverage or denied claims.

2d. Client Responsibility for Documentation and Information
You are responsible for providing accurate and complete information for all travelers at the time of booking, including full legal names (as they appear on passports or government-issued IDs), dates of birth, contact details, and any other information required by Suppliers. You are also responsible for ensuring that all travelers meet passport, visa, health, and entry requirements for all destinations and transit points (see also Section 6). Magic Wishes Vacations is not liable for any costs, delays, or denial of boarding or entry resulting from incorrect, incomplete, or missing information or documentation.

2.1. Booking Request
All booking requests must be submitted to Magic Wishes Vacations. A booking is not confirmed until a deposit has been received and you have received a written Booking Confirmation from us.

2.2. Deposit
A non-refundable deposit, as specified at the time of booking, is required to secure your reservation. The deposit amount will vary depending on the Vacation Package and Suppliers involved. We will advise you of the exact deposit amount and due date.

2.3. Final Payment
The full balance of your Vacation Package must be paid by the due date specified on your Booking Confirmation. Failure to make the final payment by the due date may result in the automatic cancellation of your booking without refund of any deposits paid.

2.4. Payment Methods
Payments can be made via [List accepted payment methods, e.g., credit card (Visa, Mastercard, American Express), bank transfer, etc.]. All payments are processed in [Specify currency, e.g., USD, CAD, EUR].

2.5. Late Bookings
For bookings made within [e.g., 60 days] of the departure date, full payment may be required at the time of booking.

3. Pricing

3.1. Inclusions and Exclusions
The price of your Vacation Package includes only those services explicitly stated in your Booking Confirmation. Unless otherwise specified, prices typically exclude:

  • International and domestic airfares (unless part of the package)

  • Visa and passport fees

  • Travel insurance

  • Excess baggage charges

  • Meals and beverages not specified in the itinerary

  • Optional excursions and activities

  • Personal expenses (e.g., laundry, telephone calls, mini-bar)

  • Gratuities and tips

  • Local taxes or resort fees payable directly at the destination

  • Any costs incurred due to unforeseen circumstances (e.g., flight delays, natural disasters)

3.2. Price Adjustments
Prices are subject to change without notice until full payment has been received. Magic Wishes Vacations reserves the right to adjust prices due to:

  • Fluctuations in currency exchange rates.

  • Increases in Supplier costs (e.g., fuel surcharges, airport taxes, hotel rates).

  • Government actions (e.g., new taxes, levies).

If a price increase occurs after your booking has been confirmed but before final payment, we will notify you immediately. If the increase is more than [e.g., 10%] of the total package price, you will have the option to cancel your booking within [e.g., 7 days] of notification and receive a full refund of all monies paid, or accept the new price.

4. Cancellations and Refunds

4.1. Cancellation by the Client
All cancellations must be submitted to Magic Wishes Vacations in writing (email is acceptable). The effective date of cancellation will be the date we receive your written notification. In addition to any Supplier penalties, Magic Wishes Vacations’ cancellation fees will generally apply as follows:

  • Deposit: All deposits are non-refundable.

  • 90 days or more prior to departure: Loss of deposit.

  • 61–89 days prior to departure: 50% of the total Vacation Package price.

  • 31–60 days prior to departure: 75% of the total Vacation Package price.

  • 30 days or fewer prior to departure: 100% of the total Vacation Package price.

  • No-show: 100% of the total Vacation Package price.

Please note that these timeframes and percentages are general industry standards and may vary by Supplier. Each Supplier (cruise line, tour operator, resort, airline, etc.) has its own specific cancellation policy, which may be stricter or different than the schedule above. In all cases, the Supplier’s policy will control and may result in additional non-refundable amounts (including, but not limited to, airfare once ticketed or certain promotional/non-refundable rates).

We will advise you of any specific Supplier cancellation terms applicable to your booking at the time of reservation. Refunds, if applicable, will be processed within 30 days of the cancellation confirmation, subject to receipt of funds from the Supplier.

4.2. Cancellation by Magic Wishes Vacations
Magic Wishes Vacations reserves the right to cancel a Vacation Package at any time prior to departure due to unforeseen circumstances beyond our control (e.g., natural disasters, political instability, insufficient bookings for a group tour). In such an event, we will:

  • Offer you an alternative Vacation Package of comparable value.

  • If no suitable alternative is available or acceptable to you, provide a full refund of all monies paid to us.

Magic Wishes Vacations will not be liable for any additional costs or consequential losses incurred by the Client as a result of our cancellation.

5. Changes and Amendments

5.1. Changes by the Client
All requests for changes to a confirmed booking must be submitted in writing. While we will endeavor to accommodate your requests, changes are subject to availability and the policies of the individual Suppliers.

  • Name Changes: May incur an administration fee of [e.g., $50] per change, plus any charges levied by the Supplier (e.g., airline re-ticketing fees).

  • Date/Itinerary Changes: May incur an administration fee of [e.g., $100] per change, plus any additional costs charged by the Supplier. If the new arrangements are more expensive, you will be responsible for the difference. If they are cheaper, no refund will be given for the difference.

  • Less than [e.g., 30 days] prior to departure: Changes may be treated as a cancellation and re-booking, subject to the cancellation fees outlined in Section 4.1.

5.2. Changes by Magic Wishes Vacations
While we strive to adhere to the published itinerary, Magic Wishes Vacations reserves the right to make minor changes to the itinerary, accommodation, or other services at any time due to unforeseen circumstances, operational requirements, or Supplier changes. Such changes are considered minor if they do not significantly alter the overall nature of the Vacation Package. In the event of a significant change (e.g., change of destination, reduction in the duration of the trip by more than 24 hours, change to a lower standard of accommodation), we will:

  • Notify you as soon as reasonably possible.

  • Offer you the option to accept the change, accept an alternative Vacation Package of comparable value, or cancel your booking and receive a full refund of all monies paid to us.

6. Travel Documents

6.1. Client Responsibility
It is the sole responsibility of the Client to ensure that all necessary travel documents (e.g., valid passport, visas, health certificates, vaccination records, international driving permits) are obtained and are valid for the entire duration of their trip, including any transit countries. Magic Wishes Vacations will provide general advice on passport and visa requirements, but this information should be verified with the relevant embassies or consulates. We accept no responsibility for any refusal of entry or exit, delays, or costs incurred due to incorrect or insufficient documentation.

6.2. Ticket and Voucher Delivery
Travel documents (e.g., e-tickets, hotel vouchers, tour confirmations) will be sent to you via email or mail once full payment has been received and approximately [e.g., 2-4 weeks] prior to departure. Please review all documents immediately upon receipt to ensure accuracy. Contact us immediately if any discrepancies are found.

7. Travel Insurance

Magic Wishes Vacations strongly recommends that all Clients purchase comprehensive travel insurance at the time of booking. This insurance should cover, but not be limited to, trip cancellation, trip interruption, medical emergencies, evacuation, baggage loss, and personal liability. We are not responsible for any losses or expenses incurred due to the lack of adequate travel insurance.

8. Client Responsibilities

8.1. Health and Fitness
You acknowledge that you are responsible for assessing your own health and fitness levels for the chosen Vacation Package. Any pre-existing medical conditions or disabilities that may affect your ability to participate in the trip must be disclosed to Magic Wishes Vacations at the time of booking. We reserve the right to decline a booking if we believe the Client's health or fitness poses a risk to themselves or others.

8.2. Conduct
You agree to conduct yourself in an orderly and acceptable manner and not to disrupt the enjoyment of other travelers. If, in our opinion or the opinion of any Supplier, your behavior is disruptive, causes damage, or is likely to cause distress or danger to others, your Vacation Package may be terminated immediately without refund.

8.3. Compliance with Laws
You must comply with the laws, customs, and regulations of all countries visited.

8.4. Baggage
You are responsible for adhering to baggage allowances set by airlines and other transport providers. Any excess baggage charges are your responsibility.

9. Company Responsibilities and Limitation of Liability

9.1. Our Role
Magic Wishes Vacations acts solely as an agent for the Suppliers providing the services included in your Vacation Package. We do not own or operate any aircraft, hotels, or other facilities or services.

9.2. Limitation of Liability
Magic Wishes Vacations shall not be liable for any loss, damage, injury, delay, inconvenience, or expense whatsoever to you or your property, howsoever arising, including but not limited to:

  • Acts or omissions of Suppliers or their employees.

  • Force Majeure events (see Section 9.3).

  • Any act or omission of any third party not under our direct control.

  • Your failure to obtain proper travel documents.

  • Your failure to adhere to the itinerary or instructions provided.

  • Any loss or damage to baggage or personal effects.

  • Any medical or health-related issues.

Our liability for any claim arising from your booking shall be limited to the total amount paid by you for the Vacation Package, excluding any non-refundable deposits.

9.3. Force Majeure
Magic Wishes Vacations shall not be liable for any failure or delay in performing its obligations under these Terms and Conditions if such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, strikes, natural disasters, epidemics, pandemics, government restrictions, or adverse weather conditions ("Force Majeure"). In such events, we will endeavor to provide alternatives or refunds as per Supplier policies, but no additional compensation will be provided.

10. Complaints

If you have a complaint during your vacation, you must immediately inform the relevant Supplier (e.g., hotel management, tour guide) to allow them the opportunity to resolve the issue. If the issue is not resolved to your satisfaction, you must notify Magic Wishes Vacations in writing within [e.g., 30 days] of your return date, providing full details of the complaint. Failure to follow this procedure may affect our ability to investigate and resolve your complaint.

11. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of [Specify your jurisdiction, e.g., the State of New Jersey, USA], without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of [Specify your jurisdiction, e.g., the State of New Jersey, USA].

12. Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired.

13. Entire Agreement

These Terms and Conditions, together with your Booking Confirmation, constitute the entire agreement between you and Magic Wishes Vacations concerning your Vacation Package and supersede all prior agreements, understandings, and representations, whether oral or written.

14. Privacy Policy

Magic Wishes Vacations is committed to protecting your privacy. We collect, use, and store your personal information in accordance with our Privacy Policy, which is available on our website at www.magicwishesvacations.com/privacy-policy. By booking with us, you consent to our collection and use of your personal data as outlined in our Privacy Policy.

15. Acceptance of Terms

By proceeding with a booking and making a payment, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you are making a booking on behalf of others, you confirm that you have the authority to do so and that all members of your party accept these Terms and Conditions.
